These Terms of Use (“Terms”) govern the access and use by you of the technology, applications, websites, content, products, and Services made available by “ Grow Man Health ” collectively also referred as (“we” or “us”).

1. About Grow Man Health

Grow Man Health provides independent health caregivers (“Care Givers”) for in-home personal care (“Service”) for you or another person who is a parent or relative(“Patient”). Grow Man Health does background and experience verification of these Care Givers via independent background verification company. The Service is provided by these Care Givers only and not by Grow Man Health.

2. Customer Agreement

You on behalf of patient request Grow Man Health to provide Service at home or any other location agreed with Grow Man Health. You agree that the Service is advised by a legal practitioner and you undertake the responsibility of Service and risks involved. Grow Man Health will ensure high quality of Service but will not be responsible for any Service error including criminal activity by Care Givers. You understand and agree that the Service offered by Grow Man Health directly or through Care Givers/affiliates of Grow Man Health has a risk of failure and/or adverse effects resulting in possible mortality or permanent disability. You understand and agree that Grow Man Health does not guarantee any recovery or outcome from the Service offered. You agree to provide safe environment for Care Givers to discharge their duty and you will ensure that they are not harassed, abused or troubled in any way physically or emotionally. You authorise Grow Man Health to collect Patient’s data and use/share the same with others (without revealing Patient’s identity). Grow Man Health will not be responsible for misuse of Patient’s data by Care Givers, affiliates, employees or other party. You will make payments to Grow Man Health as per the terms agreed and will not link it with outcome of the Service.

3. Scheduling Appointments

Appointments for Service with Grow Man Health can be scheduled through the Grow Man Health website or WhatsApp or by calling 9226456249. Your request for Service is only accepted when you receive a booking confirmation from Grow Man Health.

4. Care Giver Selection

Grow Man Health has a pool of Care Givers to choose from to provide the Service. Grow Man Health will ensure that the Care Giver assigned is as per your preference but this may not be possible all the time. Grow Man Health reserves the right to assign any Care Giver as it deems fit for that Service. Grow Man Health does not guarantee that same Care Giver is assigned on all days. Grow Man Health can assign any Care Giver on any day as it deems fit without prior notice.

5. General Payment Terms

The payment can only be made via cash, payment gateway or UPI You agree to make payment as soon as the demand is raised. Grow Man Health reserves the right to cancel an ongoing or future appointment if payments are not made on time.

Taxes: All Charges and fees are exclusive of applicable taxes. Additional taxes will be applicable as per the rules.

6. Intellectual Property Rights

All the intellectual property used on the Websites by Grow Man Health, service providers or any third party shall remain the property of Grow Man Health, service provider or any other third party as the case may be. You agree not to circumvent, disable or otherwise interfere with security related features of the Website or features that prevent or restrict use or copying of any materials or enforce limitations on use of the Website or the materials therein. The Service is protected to the maximum extent permitted by copyright laws, other laws, and international treaties. Content displayed on or through the Services is protected by copyright as a collective work and/or compilation, pursuant to copyrights laws. The materials on the Websites or otherwise may not be modified, copied, reproduced, distributed, republished, downloaded, displayed, sold, compiled, posted or transmitted in any form or by any means, including but not limited to, electronic, mechanical, photocopying, recording or other means.

7. Limitation of Liability

In no event shall Grow Man Health be liable for any special, incidental, indirect or consequential damages of any kind in connection with these terms of use, even if user has been informed in advance of the possibility of such damages. In no event shall the total aggregate liability of Grow Man Health to a user or professional for all damages, losses, and causes of action (whether in contract or tort, including, but not limited to, negligence or otherwise) arising from this agreement or a user’s use of the website or the services exceed, in the aggregate INR 100/- (rupees One Hundred Only).

8. Information You Provide Grow Man Health

When you request a Service from Grow Man Health, you agree to provide personal information about yourself and the Patient such as name, mobile number, date of birth, gender, weight and medical information about the Patient relevant to the Service. You agree to provide accurate personal and medical information about the Patient and your failure to do so may result in adverse consequences in delivery of Service. Grow Man Health may provide this information to assigned Care Giver as it deems fit.

9. Customized service and payment flow

Every patient is different. At Grow Man Health, upon receiving your request, we have a detailed conversation with you about your specific medical condition, and then suggest the best course of action. We ask for a payment only when you agree with our proposed plan of action as well as the costs involved. We can request online payments through SMS, email, website, or our mobile app, which also simultaneously clarifies the details of your booking. We use third-party payment service providers to make it easy for you to pay. Except in urgent situations, we commence the service only upon receiving the payment.

10. Communications from Grow Man Health

You agree on behalf of yourself and the Patient to receive communication in the form on SMS messages , email and calls on your mobile number and email id from both Grow Man Health and the Care Giver assigned to you. You agree to receive promotional messages in the form of newsletters, special offers and reminders and updates.

11. Termination

Grow Man Health may immediately terminate the Service at any time for any reason, through notice sent by post on registered postal address or email communication on registered email address.

12. Choice of Law

Terms of Use shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in Pune.

Payment Policy

• Applicable Services: All Services including Attendant, Nursing Care, Critical Care, Infant Care, Rehab Care except Physio and short term intervention service.
• Only Direct Payment to Grow Man Health: You don’t have to pay the caregiver in cash or cheque unless asked by the Grow Man Health Customer Service team. You will be paying Grow Man Health directly Online/UPI or request a cash/cheque pickup.
• Payment Mode: UPI, Online, NEFT, Cheque, and Cash payments are accepted. Grow Man Health promotes and prefers online payment in advance which enables us to pay our caregivers in time without hassle. For Cash/Cheque pickup amount should be more than Rs. 1500/- any amount below that should be paid online.
• Taxes: A 3% tax will apply to all services provided by Grow Man Health. It is accordance with prevailing tax regulations.

Payment Facilities

• Weekly: Every 7 days weekly invoice will be generated and payment for the same need to
  be paid in advance. Non advance payment will add penalty of Rs.100/- daily basis
• Monthly: This will be an advance payment service, you will need to pay 30 days payment
  in advance or else by default Weekly cycle will be applied.
• Surcharge: Surcharge will be applicable during festival season as an add-on incentive for the Caregiver to work and support the patient. Surcharge fee will be informed two days prior to any festival and it may range from Rs. 100 to Rs. 300 per 12 hours visit, depending on the festival

General Terms and Conditions on Payments

• Grow Man Health won’t be accountable if any amount paid to CG. The service fee has to be paid to Grow Man Health and under no circumstances the amount paid to the CG will be adjusted with the service fee.
• 30 days after the overdue date, if payment is not done the case will be legally filed and the dispute will be resolved in Pune district court.
• The above mentioned amount only includes payment charges for those visits where the attendance of the caregiver has been verified. The mentioned amount is not for the visits till date and it shouldn’t be considered as final amount, charges for the unverified visits will be added after getting a confirmation from the customer as well as caregiver.

REFUND POLICY

• Once the refund is initiated, your balance amount will be credited to your account within 3 working days.
• Refund will be done only through NEFT.

CANCELLATION POLICY

• You may cancel or reschedule any appointment by calling 9226456249 or through website or mobile app, no later than 24 hours prior to the scheduled appointment else you will be charged @100% of the service charge.
• In case of request for rescheduling Grow Man Health does not guarantee that it will be able to provide the same Caregiver again and on the rescheduled time.
• Grow Man Health may cancel or reschedule any appointment without prior notice.

In case of cancellation Grow Man Health will refund any advance payment made by you to Grow Man Health by for any Services.
